2. Our responsibilities

2. Keep and maintain records of work, and keep records and information in compliance with the Data Protection Act 2018.
3. The members of the institutes work within the framework of the Institutes Code of Ethics: www.aicpa-cima.com/resources/landing/code-of-ethics. The code requires accountants to comply with the principles of integrity, objectivity.
4. As members of the institutes we have a duty to observe the highest standards of conduct and integrity, and to uphold the good standing and reputation of the profession.
5. It is our duty to not exclusively satisfy your needs. In complying with the ethical requirements of the Institutes Code of Ethics we are obliged to act primarily within the public interest.
6. Provide regular reports on the progress of any work being completed on your behalf.
7. Register any issues or concerns that may be found during the term of the business and engagement with a relevant authority .
8. Uphold your data privacy rights. Use of Our Site is also governed by Our Cookie and Privacy Policies, available from www.optimyze.finance/privacy-policy.

9. If you are Our Client and We become unable to provide the services or projects agreed through incapacity or death, a Continuity Arrangement has been made. You can ask for the details by contacting connect@optimyze.finance. The purpose of Section 13 is to look after the Client interests by providing continuity of services. You will be contacted in the event of such circumstances arising and then you will have the option to decline to be covered by these arrangements.
3. Your responsibilities
1. Provide the relevant information for anti-money laundering regulations and in accordance with the Institutes and UK AML/CTF regime.
2. Ensure that records of your business activities are correct and maintained to meet the requirements of regulatory authority.
3. Disclose all relevant and correct information to us
4. Execute relevant declaration(s) for representation in accounting and tax matters under the English civil law.
5. Allow full and free access to financial and other records held by you or your third parties.
6. Refrain from anything that may prejudice our independence.
7. Understand Institutes Client Money Regulations.
8. Make any and all arrangements necessary in order to access Our Site.
9. Link to Our Site provided that:
a. You do so in a fair and legal manner.
b. You do not do so in a manner that suggests any form of association, endorsement or approval on Our part where none exists.
c. You do not use any logos or trademarks displayed on Our Site without Our express written permission.
d.You do not do so in a way that is calculated to damage Our reputation or to take unfair advantage of it.
10 .Use Our Site in a manner that is lawful.
4. Intellectual Property Rights
All Content included on Our Site and the copyright and other intellectual property rights subsisting in that Content, unless specifically labelled otherwise, belongs to or has been licensed by Us. Where a loss or damage occurs to you as a result of our failure to comply with duty of care, the limit of liability shall be decided mutually and in case would be higher than the fees due under the annual period of engagement.
Nothing in these Terms and Conditions excludes or restricts Our liability for fraud or fraudulent misrepresentation, for death or personal injury resulting from negligence, or for any other forms of liability which cannot be excluded or restricted by law. 8. Complaints and disputes
We want you to be entirely satisfied with Our Site, Our Content, and Our Services & Projects. If, however, you are not, please contact connect@optimyze.finance for the Complaints Handling Procedure.
Any disputes arising from our engagement will be subject to the procedure per Our Complaints Handling Procedure and governed by English law.
If a complaint cannot be resolved through Our Internal Complaints Handling Procedure, under the Consumer Rights Act 2015 we are required to point you towards alternative dispute resolution (ADR) providers.
9. Legislation and compliance
These Terms and Conditions, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of England & Wales.
If you are our client, We are obliged by law and the Institutes to undertake checks to ensure you and your business is operating lawfully. By agreeing to use Our Site you accept that We are authorised to complete such checks as necessary, and We would need to report, Under Money Laundering Regulations, any suspicious transactions made by you or your third party
